1. DEFINITIONS AND PARTIES

Site/Paytoskip: The website comprising the Paytoskip.com domain and its subdomains, owned by PAYTOSKIP BİLİŞİM HİZMETLERİ LTD (SLBT No: 00001743), located at Halil Toprakci Sokak Lal Court 1 Apt D3 K.Kaymakli, Nicosia /Cyprus.

Service: Digital (virtual) products and services that may be purchased on and/or provided through Paytoskip. Examples of products and services offered on Paytoskip include in-game currencies, in-game digital items/products and digital services for developing or boosting game characters.

Product: Goods and/or Services.

User/Member: A natural or legal person who is a member of Paytoskip and uses the Services offered on Paytoskip under the conditions set out in the agreements on Paytoskip.

Seller: A User who, using the Services offered on Paytoskip, offers for sale to other Users Products that they legally own and in respect of which they have the right and authority to dispose of ownership.

Buyer: A User who, using the Services offered on Paytoskip, purchases Products offered for sale by Paytoskip or a Seller.

Sales Representative: An authorised person assigned by Paytoskip to an order/transaction to ensure the smooth completion of the Services offered on Paytoskip.

2. SUBJECT MATTER AND SCOPE OF THE AGREEMENT

The purpose of this Agreement is to establish the terms, rights and obligations applicable to a Member using Paytoskip.

3. RIGHTS AND OBLIGATIONS OF THE PARTIES

3.0. Eligibility for Membership and Age Requirement

By accepting this Agreement, the Member represents and undertakes that they are over 18 (eighteen) years of age, have legal capacity to enter into transactions and have attained the mental maturity necessary to understand and accept the terms of the Agreement. Paytoskip prohibits persons under the age of 18 (minors) from registering as members of the Site. If the Member misrepresents their age, all resulting civil, criminal and financial liability shall rest exclusively with the Member (or their legal parent/guardian). Paytoskip reserves the right to close accounts and freeze balances immediately where it determines that the age requirement has not been met.

3.1. Accuracy of Member Information

The Member acknowledges, represents and undertakes that the personal and other information provided when registering with Paytoskip is true and accurate in law, and that any loss that may arise from the inaccuracy of such information shall be compensated by Paytoskip immediately and in full.

3.2. Password Security

The Member may not disclose their Paytoskip membership password to other persons and/or organisations. The right to use that password belongs exclusively to the Member. Paytoskip reserves all rights, including claims for compensation and other remedies, in respect of any claims or demands that third parties or competent authorities may bring against Paytoskip as a result of such unauthorised use.

3.3. Compliance with the Law

The Member acknowledges, represents and undertakes from the outset that they will comply with legal requirements and will not violate them while using Paytoskip. Otherwise, all resulting civil and criminal liability shall rest entirely and exclusively with the Member.

3.4. Prohibited Activities

The Member may not use Paytoskip in any manner that disrupts public order, violates public morals, disturbs or harasses others, serves an unlawful purpose or infringes the intellectual property rights or copyrights of others. In addition, the Member may not engage in activities or conduct that prevent or hinder others from using the Services, including spam, viruses and Trojan horses.

3.5. Members' Views and Opinions

Ideas and opinions expressed, written or used by Members on Paytoskip are entirely their personal views and are attributable solely to the person expressing them. Such views and opinions have no association or connection with Paytoskip. Paytoskip is not liable for any loss caused by third parties as a result of ideas and opinions expressed by the Member, or for any loss caused by the Member as a result of ideas and opinions expressed by third parties.

3.6. Disclaimer of Liability for Data Security

Paytoskip shall not be liable for unauthorised access to Member data by unauthorised persons or for damage to Member software and data, provided that Paytoskip is not at fault and has not breached its obligations under applicable legislation. The Member agrees in advance not to seek compensation from Paytoskip for any loss that may arise from the use of Paytoskip.

3.7. Unauthorised Access

The Member agrees not to access or use the software or data of other Internet users without permission. Otherwise, all resulting civil and criminal liability shall rest entirely with the Member.

3.8. Consequences of Breach

A Member who breaches one or more of the provisions set out in this User Agreement shall be personally liable, both criminally and civilly, for that breach and shall hold Paytoskip harmless against the civil and criminal consequences of such breaches. Furthermore, if such a breach results in legal proceedings, Paytoskip reserves the right to claim compensation from the Member for failure to comply with this User Agreement.

3.9. Account Termination Rights

Paytoskip has the right at any time to unilaterally restrict, close (ban) or delete the Member's membership and, where necessary, to destroy the customer's files, documents and information, except for records that must be retained under applicable legislation. The Member agrees to this action in advance. Paytoskip's obligations under applicable legislation remain unaffected.

3.10. Closure of Linked Accounts

If any User registered with Paytoskip, or any other User linked to that User, breaches this User Agreement or the Sales Agreement, all linked user accounts will be closed. If the closed accounts contain a Paytoskip balance and no harm has resulted from the actions of the relevant Users, the User will be contacted and a refund will be made to their bank account and/or through the method used to add funds. Otherwise, the relevant balance will be used to remedy the harm without any prior notice.

3.11. Identity Verification (KYC) and Transaction Limits

To ensure Platform security and comply with the applicable anti-money laundering legislation of the Turkish Republic of Northern Cyprus (TRNC) and other relevant legal obligations, Paytoskip may require identity verification (KYC) when establishing a business relationship and for transactions where it considers verification necessary. The Member acknowledges that Paytoskip also has the right to request such verification for any transaction deemed suspicious, regardless of its amount. Access to services, account balances or withdrawals may be restricted until the KYC process has been successfully completed and approved.

3.12. Platform Balance and Seller Earnings

Funds added to Paytoskip by the User may only be used to purchase products and services through the Platform; they may not be assigned or transferred to other users, used outside the Platform or converted into cash. However, seller/supplier earnings arising from the User's sales of products/services to Paytoskip or through the Platform are treated separately from funds added to the platform balance and may be paid by Paytoskip to the relevant User's bank account or through other payment methods supported by Paytoskip.
